Terms of Service

1. Acceptance of Terms

By accessing or using AgentFritz ("the Service"), operated by Switchboard Computing ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

Your continued use of AgentFritz after any changes to these terms constitutes acceptance of the updated terms.

2. Account Registration & Security

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your password and account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these terms.

3. Acceptable Use Policy

You agree not to use AgentFritz to:

  • Engage in any illegal activity or violate applicable laws
  • Abuse, harass, threaten, or intimidate other users
  • Generate malicious code, malware, or content designed to harm systems or individuals
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service
  • Circumvent rate limits, security measures, or access controls
  • Resell, redistribute, or sublicense access to the Service without authorization
  • Interfere with or disrupt the integrity or performance of the Service
  • Use automated means to scrape, crawl, or extract data from the Service

4. AI-Generated Content Disclaimer

AgentFritz uses artificial intelligence to generate responses, code, and other outputs. You acknowledge and agree that:

  • AI-generated content is provided "as-is" without any warranty of accuracy, completeness, or fitness for a particular purpose
  • Outputs may contain errors, inaccuracies, or outdated information
  • You are solely responsible for reviewing, testing, and validating any AI-generated code before using it in production
  • We do not guarantee that AI outputs will be free of bugs, security vulnerabilities, or intellectual property issues
  • AI-generated content should not be relied upon as professional, legal, medical, or financial advice

5. Subscription & Billing

AgentFritz offers free and paid subscription plans. For paid plans:

  • Payments are processed securely through Stripe
  • Subscriptions automatically renew at the end of each billing cycle unless cancelled
  • You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of the current billing period
  • Refunds are handled on a case-by-case basis at our discretion
  • We reserve the right to change pricing with 30 days' notice to existing subscribers
  • Failure to pay may result in suspension or downgrade of your account

6. Rate Limiting & Fair Use

Each plan includes a defined throughput level (tokens per second). We enforce rate limits to ensure fair access for all users. Excessive or abusive usage patterns may result in temporary throttling or account review. We reserve the right to adjust rate limits as needed to maintain service quality.

7. Intellectual Property

Your content: You retain all ownership rights to the code, text, and other content you submit to AgentFritz. We do not claim ownership of your inputs or the outputs generated from your prompts.

Our platform: The AgentFritz platform, including its design, software, branding, and documentation, is owned by Switchboard Computing and protected by intellectual property laws. You may not copy, modify, or distribute any part of the platform without written permission.

8. Privacy

Your use of AgentFritz is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

9. Termination

We may suspend or terminate your access to AgentFritz at any time, with or without notice, for conduct that we believe:

  • Violates these Terms of Service
  • Is harmful to other users, us, or third parties
  • Involves fraudulent or illegal activity

Upon termination, your right to use the Service ceases immediately. You may request export of your data prior to or within 30 days of account termination.

10. Limitation of Liability

To the maximum extent permitted by law, Switchboard Computing and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of AgentFritz.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Changes to Terms

We may update these Terms of Service from time to time. We will notify users of material changes by posting a notice on the Service or sending an email. Continued use after changes take effect constitutes acceptance of the revised terms.
